A Land
Patent is evidence of right, title, and/or interest to a tract of
land granted by the government to an individual. Most patents in the area were claimed
through homesteaded act. The General Land Office followed a
two-step procedure in granting a patent. First, the private claimant
went to the land office in the land district where the public land
(section) was located. The claimant filled out "entry" papers to
select the public land, and the land office register (clerk) checked
the local registrar records to make sure the claimed land was still
available. The receiver (bursar) took the claimant's payment,
because even homesteaders had to pay administrative fees. Next, the
district land office register and receiver sent the paperwork to the
General Land Office in Washington. That office double-checked the
accuracy of the claim, its availability, and the form of payment.
Only then did the General Land Office issue a patent relative to the
particular land in question.

The Homestead
Act of 1862 was a federal law that gave an applicant
freehold title to up to 160 acres (one-fourth section) of
undeveloped federal land outside the original Thirteen Colonies.
The law required three steps: file an application, improve the
land, and file for deed of title.
1) People interested in Homesteading first had to file their
intentions at the nearest Land Office. A brief check for previous
ownership claims was made for the plot of land in question,
usually described by its survey coordinates. The prospective
homesteader paid a filing fee of $10 to claim the land
temporarily, as well as a $2 commission to the land agent.
2) With application and receipt in hand, the homesteader
then returned to the land to begin the process of building a home
and farming the land, both requirements for "proving" up
at the end of (5) five years. When all requirements had been
completed and the homesteader was ready the take legal possession,
the homesteader found two neighbors or friends willing to vouch
for the truth of his or her statements about the land's
improvements and sign the "proof" document.
3) After successful completion of this final form and payment of a
$6 fee, the homesteader received the patent for the land, signed
with the name of the current President of the United States. This
paper was often proudly displayed on a cabin wall and represented
the culmination of hard work and determination.
Only about 40 percent of the applicants
who started the process were able to complete it and obtain title to
their homestead land. |

The image to the right is a map of the
Settlement area showing final Land Patent Grants. The 1922 plat map
is used as the background or base. The names and land tracks
of the Original Land Patent Grants have been drawing on top of this
map. The land tracks that were granted to people connected to
the German-Russian immigrates are shown in color. Other names are
either shown in white or not marked at all.
This map demonstrates a number of
points:
- The Settlement has no defining
borders.
- Some of the earliest
German-Russian settlement activate took places in the Lauchman
area in the Northeast corner of the map.
- A sizeable number of land
tracks were granted before the German-Russians started to
homestead. (There were others who had settled in the area before
the German-Russians.)
- By 1922, much of the land
owned by others was taken over by German-Russians either through
trading or sale, enlarging and saturating the core area of the
Settlement
